Ye (Kanye West) Hit With New Lawsuit Over Uncleared ‘Vultures 2’ Sample

Ye (formerly Kanye West) has been hit with a lawsuit after allegedly using an unauthorised sample on the track ‘530’ from Vultures 2.

Ye (formerly Kanye West) has been hit with yet another lawsuit, which alleges the artist rapped over an unauthorised sample on the track ‘530’ from his album Vultures 2.

The lawsuit obtained by Billboard would be filed on Thursday (February 12) by alternative R&B artist Swsh (Remy Quillin) and U.K. based indie label Future Bounce against Ye and Vultures 2 collaborator Ty Dolla $ign.

The complaint would also bring federal copyright infringement claims to Ye’s in-house label YZY and the service Label Engine, which Swsh would allege handled the digital distribution for the named track, which appeared on Vultures 2 in 2024 and was later re-released a year later on Donda 2.

Swsh would go on to outline in his lawsuit that his 2018 track ‘Break the Fall’ is sampled without a license. The complaint would then specify that his outro vocals are looped repeatedly beneath Ye’s verses throughout the first two minutes of the track.

“By exploiting Swsh’s creative output without credit or compensation, defendants usurped the commercial and artistic value of their sound recording and underlying musical composition while misrepresenting its authorship to the public,” reads the lawsuit. “This unauthorised use deprived plaintiffs of rightful sales and licensing revenue, diminished the value of their work and interfered with their ability to control how that work is experienced and perceived.”

Swsh would also allege that they had sent demand letters to Ye’s reps about the alleged infringement shortly after Vultures 2 was released, but the issue was not resolved. Despite being alerted to the infringement, the lawsuit claims that Ye re-released ‘530’ a year later on his album Donda 2, without a sampling license, yet again.

“Such willful, knowing and deliberate conduct reflects a conscious decision to misappropriate plaintiffs’ intellectual property and to profit from it,” the lawsuit says.

This new lawsuit seeks financial damages for Swsh and Future Bounce, including lost royalties. While no specific dollar amount is specified, the lawsuit notes that ‘530’ has more than 50 million streams on Spotify.

Last year, Ty Dolla $ign settled a separate copyright lawsuit alleging that the artist used an uncleared sample on Vultures 1. Swsh complaint marks yet another lawsuit against Ye, who has faced at least 10 such cases since 2019.
