Former I Prevail vocalist Brian Burkheiser has confirmed that his long running legal issues with the band are officially resolved, clearing the way for new music under his solo project Scatterbrain.
Burkheiser revealed the update on Thursday (February 5th), announcing that he is now able to move forward independently after months of legal complications that stalled the project’s momentum, the dispute first came to light in August last year, when Burkheiser explained that unresolved issues with I Prevail had prevented him from properly launching Scatterbrain.
Despite those roadblocks, the vocalist quietly re-emerged in December with a cover of Taylor Swift’s ‘Look What You Made Me Do’, offering the first glimpse of his post I Prevail direction.
Now, with the legal situation behind him, Burkheiser is preparing to release his first original material under the Scatterbrain banner.
Scatterbrain ‘PHASES’ Friday, February 13th
The new track, titled ‘PHASES’, is set to arrive next Friday, February 13, alongside an accompanying music video.
In a statement, Burkheiser addressed both the legal resolution and the significance of finally being able to release music without restrictions:
“I’m grateful to share that I am officially a free, independent artist, and will be releasing my own original music under the name SCATTERBRAIN.
I want to sincerely thank Fearless and Concord Records for their professionalism, respect, and support throughout a very complicated period.
Now that my legal dispute is behind me, I’m ready to share my story.
My first original song, “PHASES“, along with the music video, drops next Friday.

While Burkheiser hasn’t detailed the nature of the dispute itself, the announcement closes a turbulent chapter following his departure from I Prevail and signals a clean break creatively and professionally.
What Scatterbrain ultimately sounds like remains to be seen, but with ‘PHASES’ positioned as his first fully original release, it marks a decisive step forward rather than a footnote to past tensions.
After months of silence and speculation, Burkheiser is finally able to speak through his own music, on his own terms.
